Welcome to Delta Whiskey Apparel. These Terms of Service (“Terms”) govern your access to and use of deltawhiskeyapparel.com, including all related information, products, features, tools, and services offered through the website (collectively, the “Services”).
The Services are operated by Delta Whiskey Apparel and powered by Shopify. By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms, our Privacy Policy, our Returns and Exchanges Policy, and any other policies referenced on the website.
If you do not agree to these Terms, do not use the Services.
SECTION 1 — ELIGIBILITY
You must be at least the age of majority in your state of residence to make a purchase through the Services. If you are under the age of majority, you may use the Services only with the involvement and permission of a parent or legal guardian.
By using the Services, you represent that you have the legal capacity to enter into these Terms.
SECTION 2 — ONLINE STORE TERMS
You may use the Services only for lawful purposes. You may not use our products, website, or Services in violation of applicable federal, state, or local law.
You may not introduce viruses, malicious code, automated scraping tools, or other technology intended to damage, disrupt, gain unauthorized access to, or interfere with the Services.
We reserve the right to suspend or terminate access to the Services when we reasonably believe these Terms have been violated.
SECTION 3 — GENERAL CONDITIONS
We reserve the right to refuse or cancel service or orders when reasonably necessary, including in cases involving suspected fraud, abusive conduct, unauthorized resale, payment problems, pricing errors, inventory limitations, or violations of these Terms.
You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our prior written permission.
Headings are included for convenience and do not limit or otherwise affect these Terms.
SECTION 4 — ACCOUNT AND CUSTOMER INFORMATION
You agree to provide accurate, complete, and current information when creating an account, placing an order, or communicating with us.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Notify us promptly if you believe your account has been accessed without authorization.
We are not responsible for delays, failed deliveries, or additional expenses caused by incorrect or incomplete information provided by a customer.
SECTION 5 — PRODUCTS AND PRODUCT INFORMATION
Certain products may be available exclusively through our online store and may be produced or fulfilled after an order is placed.
We make reasonable efforts to display product descriptions, images, colors, sizing information, and specifications accurately. However, colors and product appearance may vary depending on your device, screen settings, manufacturing process, garment blank, or production batch.
Minor differences in color, placement, dimensions, or appearance that occur within normal manufacturing tolerances are not necessarily considered defects.
Product availability, descriptions, designs, and pricing may be changed or discontinued without notice. We reserve the right to limit product quantities or sales when reasonably necessary.
Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.
SECTION 6 — ORDERS, PRICING, AND PAYMENT
Submitting an order does not guarantee acceptance. An order is accepted when we confirm and begin processing it.
We may cancel, refuse, or limit an order because of suspected fraud, payment problems, inventory shortages, fulfillment restrictions, inaccurate information, pricing errors, or other legitimate business reasons.
If payment has already been collected for an order we cancel, we will issue a refund to the original payment method.
Prices may change without notice. The price charged will be the price displayed at checkout when the order is submitted, subject to correction of obvious pricing or system errors.
You authorize Shopify and the applicable payment provider to charge the payment method selected at checkout for the order total, including applicable shipping charges and taxes.
SECTION 7 — ORDER CHANGES AND CANCELLATIONS
Contact us immediately if you need to request a change or cancellation. We cannot guarantee that an order can be changed or canceled after it has entered production, fulfillment, or shipping.
Orders that have already entered production may be subject to the terms of our Returns and Exchanges Policy.
SECTION 8 — SHIPPING AND DELIVERY
Processing and delivery estimates are provided for convenience and are not guaranteed delivery dates. Production volume, supplier availability, quality-control reviews, severe weather, carrier interruptions, holidays, and other circumstances may affect delivery.
Orders containing multiple products may be fulfilled from different facilities and may arrive in separate packages.
Tracking information will be provided when available. Tracking systems can require additional time to display movement after a shipping label is created.
Customers are responsible for providing a complete and accurate delivery address. If an order is returned because of an incorrect or incomplete address supplied by the customer, the customer may be responsible for additional shipping costs.
If tracking indicates that a package was delivered but you cannot locate it, check the delivery area, household members, neighbors, building management, and the carrier. You may also contact us for reasonable assistance with tracking information or a carrier investigation.
Carrier delays and delivery scans are not within our direct control, but this does not limit any responsibility we have under applicable law.

SECTION 9 — RETURNS, EXCHANGES, AND REFUNDS
Returns, exchanges, replacements, and refunds are governed by our Returns and Exchanges Policy.
Customers must contact us before sending an item back. Merchandise returned without prior approval or to an unauthorized address may not be accepted.

If these Terms conflict with the Returns and Exchanges Policy regarding a return or refund, the Returns and Exchanges Policy will control for that issue.
SECTION 10 — PROMOTIONS AND DISCOUNTS
Promotional offers, discount codes, free-shipping offers, giveaways, and other incentives may be subject to separate terms, eligibility requirements, expiration dates, product exclusions, or minimum purchase amounts.
Unless otherwise stated, promotions cannot be combined. Discounts have no cash value and cannot be applied retroactively to completed orders.
We may modify or end a promotion where permitted by law. We will not create false urgency or retroactively change the terms of an already completed qualifying purchase.
SECTION 11 — INTELLECTUAL PROPERTY
The website and its content, including the Delta Whiskey Apparel name, logos, original graphics, product designs, text, photographs, videos, layout, and other materials, are owned by Delta Whiskey Apparel or used with permission from their respective owners.
Nothing on the website grants you ownership of or a license to use our intellectual property except for the limited personal access necessary to shop through the Services.
You may not reproduce, modify, distribute, sell, publish, or commercially exploit protected content without the written permission of the applicable rights holder.
SECTION 12 — REVIEWS, FEEDBACK, AND USER CONTENT
If you submit a review, photograph, comment, suggestion, or other content, you retain any ownership rights you legally hold in that content.
You grant Delta Whiskey Apparel a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share the submitted content in connection with operating, promoting, and improving our business and Services.
You represent that you have the right to submit the content and that it does not violate another person’s intellectual-property, privacy, publicity, or other legal rights.
We may remove content that is unlawful, misleading, abusive, defamatory, infringing, fraudulent, or otherwise inappropriate.
SECTION 13 — PROHIBITED USES
You may not use the Services to violate a law, infringe intellectual-property rights, harass or harm another person, submit false information, transmit malicious software, collect another person’s information without authorization, interfere with website security, impersonate another person, conduct fraudulent transactions, or evade purchasing restrictions.
We may investigate suspected misuse and cooperate with lawful requests from government authorities.
SECTION 14 — THIRD-PARTY SERVICES AND LINKS
The Services may contain tools, applications, integrations, or links provided by third parties. These third parties may have their own terms and privacy practices.
We do not control and are not responsible for third-party websites or services. Review the applicable third-party terms before using them or providing personal information.
The inclusion of a third-party link does not necessarily constitute endorsement.
SECTION 15 — SHOPIFY AND PRIVACY
Our store is hosted by Shopify. Shopify processes information concerning your access to and use of the Services to provide and improve its ecommerce services, including certain services informed by customer interactions with Shopify and other merchants.

SECTION 16 — DISCLAIMER OF WARRANTIES
Except where prohibited by law or expressly stated in writing, the Services and website content are provided on an “as available” basis.
We do not guarantee that the website will always be uninterrupted, error-free, completely secure, or compatible with every device.
Nothing in this section excludes warranties, remedies, or consumer protections that cannot lawfully be excluded.
SECTION 17 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Delta Whiskey Apparel and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages resulting from the use of or inability to use the Services.
This limitation does not apply where liability cannot legally be limited, including where applicable law provides otherwise.
SECTION 18 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold Delta Whiskey Apparel harmless from third-party claims, damages, losses, and reasonable expenses resulting from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another party’s rights.
This obligation does not apply to the extent a claim results from Delta Whiskey Apparel’s own unlawful conduct.
SECTION 19 — EVENTS BEYOND OUR CONTROL
We are not responsible for a delay or failure caused by circumstances reasonably beyond our control, including severe weather, natural disasters, labor interruptions, supplier shortages, carrier disruptions, internet outages, government actions, or widespread service failures.
We will make reasonable efforts to communicate significant disruptions and complete affected obligations when reasonably possible.
SECTION 20 — TERMINATION
These Terms remain effective until terminated by you or us.
You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms or use the Services unlawfully.
Provisions that by their nature should survive termination, including intellectual-property rights, limitations of liability, indemnification, and governing-law provisions, will remain in effect.
SECTION 21 — GOVERNING LAW
These Terms are governed by the laws of the State of Idaho and applicable federal law, without regard to conflict-of-law principles.
Subject to any consumer rights that cannot be waived, legal proceedings concerning these Terms will be brought in the appropriate state or federal courts serving Ada County, Idaho.
SECTION 22 — SEVERABILITY
If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or removed where necessary. The remaining provisions will continue in effect.
SECTION 23 — NO WAIVER
A failure to enforce any provision of these Terms does not waive our right to enforce that provision or another provision later.
SECTION 24 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Returns and Exchanges Policy, Shipping Policy, and other policies displayed on the Services, constitute the agreement between you and Delta Whiskey Apparel concerning your use of the Services.
SECTION 25 — CHANGES TO THESE TERMS
We may update these Terms to reflect changes to our Services, business practices, or legal obligations.
The revised Terms will be posted on this page with an updated revision date. When required by law, we will provide additional notice.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those changes.
